Summary

➡ Sheriffs Dan Marks from Iowa and Dale Wagner from Washington State are facing scrutiny from their respective Attorney Generals (AGs) over their cooperation with ICE (Immigration and Customs Enforcement). While Wagner is being sued for allegedly breaking state law, Marks is willing to cooperate with ICE, but only if they provide a warrant. Despite the pressure from their AGs, both sheriffs maintain their autonomy, as they are accountable to the people of their counties, not the state legislature, governor, or president.

Transcript

So, our response right now, folks, is Sheriff Dan Marks from Iowa, we’ve talked about him on the program before, and Sheriff Dale Wagner in Washington State. Both are being contacted by their AGs, kind of like the California one that we’re going to be watching you. Well, Sheriff Wagner in Washington State is being sued by his attorney general saying that he is breaking, just like the progressives told Sheriff Redmond, you’re breaking state law, okay? Because the law says in California that you can’t help with ICE, okay? And so, on the other hand, Sheriff Marks in Iowa is saying he will help totally, but for one caveat, that he will require turning people over to ICE if ICE has a warrant for them, just like the Fourth Amendment says.

I have said, and I’ve told it to Sheriff Marks, I just talked to him two days ago, I said, look, I’m not sure you’re wrong, but on that, I don’t know if you have to have, if a detainer, just a request, because when I was sheriff, and a neighboring sheriff, even in like New Mexico, which was close to where I was, New Mexico is just 45 minutes from Safford or Graham County, where I was sheriff. If they said, hey, I know you’re going to release this guy, but could you just hold him until we come and get him? We believe he’s a suspect in an armed robbery here.

I would do it. I would do it. So, if you’re doing an investigation, you want to pick somebody up in my county? Yeah, I would probably say, of course we’ll cooperate. Would I prefer that they have a warrant? Sure. And those aren’t that hard to get. So, I told Sheriff Marks, if this is what you believe, he’s had my class. He said, he quotes my class all the time. He quotes my decision all the time. And I’m being fair and honest with him, just like I am with all of you. I’m not sure that that is required, but I do know if Sheriff Marks wants that to happen, and even though he’s under a threat, being watched by his attorney general of the state, two opposite views from two different attorney generals, and what do we have? The bottom line is this, folks.

The AG in Iowa cannot tell Sheriff Dan Marks what to do. The AG in Washington state cannot tell that sheriff what to do. Sheriff Wagner, he cannot tell you what to do. Can the state legislature? No. Can they pass a law saying he has to? They can pass it all he wants, but he doesn’t answer to them, because these people do not understand what a constitutional republic is. Do all of us get what a republic is? A republic is where the people are in charge, and the people choose their representatives.

And who is the sheriff’s boss? We the people in his county are his boss. Is the state legislature the boss? No. Is the governor? No. Is the president? No. None of them. In fact, the last on that list is the federal government. The federal government cannot tell your sheriff what to do. I don’t care if it’s the president or Tom Holman or the AG or anyone else. They do not answer to the federal government. So, sorry. So, the answer and the bottom line with the CSP way stands on this, both sheriffs are correct.

They answer to their people, not to the AG, and the AGs need some schooling on this. So, we’re going to have our next big event in Washington state, and we’re going to have sheriff Marx there. And hopefully, sheriff Wagner, he hasn’t given us his okay yet, but Marx has. And hopefully, we’ll get California sheriff Redmond there. We will have a couple of sheriffs from California there. So, hopefully, several from Oregon, several from Washington state. And we’re going to make this happen, because that’s what the CSP way does. And our training and our efforts to make sure sheriffs know we’re backing them.

That’s why we’re having it. So, anyway, thank you so much for that. That’s a great flick. A great flick, a great video. We have a second article that goes with that, just because we’re talking about it. But when you’re talking about Chuck Jenkins last week, and we have an article here from the state of Maryland, where the sheriffs are saying, they see Maryland, of course, is attempting to come up with a law that says that they cannot, they call it the Maryland Values Act, of course, one of three bills and immigrant rights would prohibit agreements between local agencies and federal immigration authorities.

And anyway, they already have some sheriffs in the counties of Hartford, Frederick and Cecil that are cooperating with ICE. And Chuck Jenkins says the bill is a terrible and dangerous piece of legislation. He said it would encourage criminals who have legally entered the U.S. to establish themselves. He also said that since 2008, we removed 1,795 criminals, most of them felons, we removed them because of our partnership with ICE and that 287-G program that they’re functioning under where they cooperate. So anyway, you have the state of Maryland, you know, already passed the House, has already passed this Maryland Values Act.

And I guess the Senate will follow suit. And then we’ll have some people like Chuck Jenkins have to just do what they feel is correct and not what the state’s telling them to do, just like Redmond. I don’t know if you’d seen that or not. Well, and don’t confuse everybody. Don’t confuse Sheriff Chuck Jenkins of Maryland with Sheriff Scott Jenkins of Virginia. Right. And we’re still working to get him a pardon. And I need to get a hold of his wife because Sheriff Scott Jenkins has not returned my calls for the last few days.

I hope he hasn’t had to already report to prison. But anyway, I’ll take care of that part. Okay, I’m going to put that on my notes to keep reminding you. It’s an interesting story to follow. [tr:trw].
