Summary

➡ Sheriff Dan Marks from Iowa is being sued by his state attorney general for not fully cooperating with ICE (Immigration and Customs Enforcement). Despite this, he insists on only turning over suspects to ICE if they have warrants signed by a judge, arguing that administrative warrants are not constitutional. This has sparked a debate about the due process rights of illegal immigrants, with some arguing that they should not be entitled to the same rights as citizens. The case is likely to go to the state Supreme Court of Iowa, where Marks will argue that as a sheriff, he only answers to the citizens in his county.

So, Jack, I got to tell you, I saw an article that you sent me about Sheriff Dan Marks in Iowa. Okay. And I called him this morning, and he says, hey, Sheriff, I’ve got a lot of meetings today. I saw that it was you. I wanted to talk to you. And so we talked only about five minutes. He was just headed to a meeting with his sheriff’s office staff. And this is a real good guy. He’s really sincere. And after we talked about—I wanted him on the show today, but his lawyers have told him not to come on shows.

And I said, well, I said, Sheriff, you know I only want to talk to you about what you’ve already talked about regarding your case. Folks, Sheriff Dan Marks is actually getting sued by his state attorney general for not totally cooperating with ICE. And he is cooperating, but he’s just not cooperating totally. So that wasn’t a mistaken term. He’s helping, but he was the one, folks, that this made the national news, that he wanted to make sure that ICE had duly signed warrants. Let’s see, where do we see that? That would be Amendment 4, the Fourth Amendment, you know, just two after the Second Amendment.

Let’s see, did I get my math right, Jack? Yeah. Okay. So math was never my best subject, but I do okay. But folks, he said he would not turn over arrestees or inmates or suspects to ICE if they didn’t have duly signed warrants. He said that administrative warrants are not constitutional. They have to be signed by a judge. So anyway, remember back when he first did this, Jack, and I said, I’m not sure that he’s right or wrong. Right. Correct. I think if we were to err on this, though, that he’s probably right. Okay. But I also said this, if ICE is investigating and ICE knows that there is a suspect in your jail, and I know we’ve done this before, could you please just turn him over to us so we can take care of this? And I’m still starting to wonder, Jack, do all these illegal aliens get every bit of due process as detailed within Amendment 5 and 6, especially 6, 6 details due process? And there’s about nine steps in there that people get, you know, so they get a public and speedy trial.

That could be two of the principles of the Sixth Amendment right there. They get a lawyer. They get to know the charges against them. They get to face their accusers. And well, I just did five or six. So what else is there in there? Anyway, I think I did pretty good coming up with six. But regardless, our Amendment 6 has detailed due process for everyone. Okay. And so I just, I am wondering, and I’m not, as much as I know about the Constitution, I’m still wondering, if the only thing that the government is doing is simply sending you home.

They’re not taking life or limb. They’re not really arresting you. They’re detaining you and sending you home. I don’t see how that requires all the due process, because first of all, logistically, this was the Biden administration making this huge mistake and allowing 20 million people, maybe more, that goes back and forth. I think there’s quite a bit more than 20 million people that have come into our country illegally that terrorists, cartels, gangs, and all sorts of horrible people that we do not want here, that sheriffs and mayors and chiefs of police do not want in their communities.

And if we just say, you’re not a citizen, you cannot vote, oh, you tried to vote, we’re going to send you home. Does that require every step within Article Amendment 5 and Amendment 6 that they get, which would take 200 years to do that to 10 million people? And I just, I don’t think so. I’m going to give you my honest opinion now. I said on another radio show or another interview with Mike Adams that they get due process. And he said, oh, they get all the rights that are guaranteed in the Constitution. He asked me that question.

I said, yeah, I think so. And he goes, how about the right to keep and bear arms? I said, no, I don’t think they should get that. And so even though Biden said, we don’t get the right to keep our arms, but illegal aliens do. And of course, he called them immigrants. So, folks, I think there’s some legitimate gray area here that deserves some discussion. And no, I’m not turning my back on the Constitution, but I want to recognize and analyze this very openly and honestly. If I’m just sending someone home, do I have to hire them a lawyer for that? And no, I don’t want to do it to anyone who is a bona fide citizen of America.

I don’t want that to happen. But anyone that’s a bona fide citizen should easily be able to prove that. And even if they’re just proving that they’re a citizen of Arizona or Texas or Montana, it doesn’t make any difference. If I’m a citizen of Arizona and I can prove it, they cannot send me back. And folks, I am totally up on this. I believe we should have identification to be able to vote. So just any Tom, Dick and Harry who is not even from our country will not be able to commit voter fraud and election fraud and sway an election when we are the ones that have that right.

And it is our stewardship as Americans. So God bless us as we slice and dice through this and dissect all of this. But anybody who disagrees with me, please let me know. Email me or just put your chat on the chat room, put your information on the chat room, because I really don’t believe that that rises to the level of qualifying for all the due process rights because we’re simply taking you home. And so, yeah, anyway, what was said about Sheriff Marks, again, they’ve gone after him. They’ve blasted him for not 100 percent cooperating with ICE.

And now it’s going to court. And I don’t think he’s going to be done. And he doesn’t think he’s going to be done because it’s probably going to go to the state Supreme Court of Iowa. And I think he will win because first and foremost, and I told him I hope they call me as an expert witness because somebody needs to tell him there’s documentation that the sheriff does not answer to you. Attorney General, state legislature, governor, you are not his boss. And we have the evidence of that. And our Supreme Court kind of backs that up.

But where the United States government has no authority over your sheriff, does the state government at all? I mean, they do. The legislative branch does do criminal codes. Is the sheriff required by law to enforce those? Or does he simply do it because he knows it’s the right thing to do and it’s part of his job. But, you know, if a sheriff refuses to investigate a murder, can he be charged? Can he be fired? No, he cannot. We can fire him or recall him. We the people the next time he’s up for election.

Or we can recall him and say, why are you being such an inept sheriff? And we want you gone. Those don’t work very often, but they have a time or two. And our good sheriff in Nebraska, Sheriff Smith, he had that happen to him and he got thrown out of office. We defended him and I still do. He was a good sheriff and a good man. But now Sheriff Marks, M-A-R-X, is saying, I’m going to take this to court because I believe the sheriff is independent and he only answers to the citizens in his county.

And he’s saying that. And you know what he told me right before we hung up? He said, Sheriff Mack, I got to tell you something honestly here. Damn you, I blame you for all of this. And I said, okay, go ahead and explain it. He goes, Sheriff Mack, if it wasn’t for you, I would not be doing this. You changed America. And I’m doing this because I really believe in what you came and taught us out here in Iowa. And he said, I read your books before that. And he did. I met him there about seven or eight years ago.

And they had several sheriffs that came to our event. And he said, I cannot go away from what I know I’ve learned. And he said, so much of this is from you. And I said, that’s the best, worst compliment I’ve ever had. So he’s a sincere guy. He’s a good man. He’s a good constitutional sheriff. And he certainly has the right to fight this. And God bless him as he does. He believes in the Fourth Amendment, believes in the Constitution, and he’s trying to do his best to keep his oath. So don’t we wish we had more sheriff Marx’s all over the country? Yes.
